Shark protection in Vietnam

Currently, there are no criminal punishments for violations involving sharks. Administrative fines are only applicable for a number of sharks with the maximum amount of VND 100 million, under Decree 103/2013/ND-CP (amended by Decree 41/2017/ND-CP).

Decree 103/2013/ND-CP (amended by Decree 41/2017/ND-CP): Any offenders exploiting, trading, collecting, raising, keeping, and processing these shark species will be subject to an administrative fine up to VND 100 million. Also, the wildlife involved will be confiscated.

 

The new Penal Code (effective on January 1, 2018): If the number of sawfishes is greater than or equal to 10, any act of illegally hunting, killing, keeping, transporting, trading individuals; possessing, transporting, trading vital parts or products of these sawfishes must be prosecuted. If the number of wildlife individuals is lower than the aforementioned figure, but the subject has already been administratively fined or criminally punished for the same act and has not been entitled to remission of criminal record, the subject shall be prosecuted. Offenders will serve at most 15 years in prison.

The new Penal Code (effective on January 1, 2018): If the value of the confiscated animals is VND 300 million and upwards, any act of illegally hunting, killing, keeping, transporting, trading individuals; possessing, transporting, trading parts or products of these shark species will be prosecuted. If the number of wildlife individuals is lower than the aforementioned figure, but the subject has already been administratively fined or criminally punished for the same act and has not been entitled to remission of criminal record, the subject shall be prosecuted. Offenders will serve at most 12 years in prison.
